Inspections are done in accordance with ASHI standards and is considered a visual inspection based on the areas specifically identified in the written report. Any areas which is not exposed to view, is concealed, is inaccessible because of soil, walls, floors, carpet, ceilings, furnishings, storage materials ,snow, ice, water, soot and any other area as to agreed by the inspector and client are excluded in the inspection .Inspector will not conduct geological tests, and will not inspect areas which are concealed areas of the property, will not enter dangerous areas that may risk physical harm to the inspector or enter areas that would risk damage to the property itself. The inspector does not dismantle any component or system. This is beyond the scope of the inspection. Full evaluation of the integrity of a heat exchanger requires dismantling of the furnace and is also beyond the scope of the inspection. The home inspection is not a compliance inspection or certification of compliance with past or present governmental codes or building regulations of any kind.
Other areas specifically excluded from the inspection are water softening systems, security systems, telephone and tv cables, swimming pools & spas, underground and concealed pipes, sewer lines, septic systems, electrical lines & circuits, central vacuum systems. Also excluded, but not limited to: radon,formaldehyde,lead paint,asbestos, toxic & flammable materials, molds, fungi, other environmental hazards; pest infestation, sprinkling systems, household appliances, recreational equipment, humidifiers and other heating system accessories. Client understands that these systems, items, and conditions are excluded from the inspection. Any general comments about these items on the written report are informal only, and do not represent an inspection.
This inspection report is based on the condition of the property existing and apparent as of the time and date of the inspection. Not all conditions may be apparent on the inspection due to weather conditions, inoperable systems, inaccessible areas of the property, etc.. Without dismantling the house or its systems, there are limitations to the inspection. Throughout any inspection, inferences are drawn which cannot be confirmed by direct observation. Clues and symptoms often do not reveal the extent or severity of problems. Therefore, the inspection and inspection report may help reduce the risk of purchasing the property; however, an inspection does not eliminate such risk nor does the inspector assume such risk. Inspector is not responsible, nor liable for the non discovery of any patent or latent defects in materials, workmanship, or other conditions of the property, or any problems which may occur or may become evident after the inspection time and date. Inspector is not an insurer nor guarantor against defects in the building and improvements, systems, or components inspected. Inspector makes no warranty, express or implied, as to the fitness for use or condition of the systems or components inspected. Inspector assumes no responsibility for the cost of repairing or replacing any unreported defects or conditions, nor is inspector responsible or liable for any future failures or repairs.
THE INSPECTION AGREEMENT, THE HOME INSPECTION, AND THE INSPECTION REPORT DO NOT CONSTITUTE A HOME WARRANTY, AN INSURANCE POLICY, OR A GUARANTEE OF ANY KIND; NOR DO THEY SUBSTITUTE FOR ANY DISCLOSURE STATEMENT AS REQUIRED BY LAW. THERE ARE NO WARRANTIES MADE AGAINST ROOF LEAKS, WET BASEMENTS, OR BREAKDOWN OF ANY MECHANICAL SYSTEM. THE REPORT IS A PROFESSIONAL OPINION BASED ON THE VISUAL INSPECTION OF THE VISIBLE AND ACCESIBLE AREAS OF THE PROPERTY AND IS NOT CONSIDERED A LISTING OF REPAIRS NEEDED. THE INSPECTOR IS NOT ASSOCIATED WITH THE SELLER, BUYER, CONTRACTOR, LAWYER, OR REALTOR. OTHER THAN THE INSPECTION FEE, INSPECTOR HAS NO FINANCIAL INTEREST IN THE PROPERTY.
Liability for errors and omissions in this inspection is limited to the cost of the inspection. This amount shall be deemed liquidated damages, and the client agrees to immediately accept a refund of the fee as full settlement of any and all claims which may arise from this inspection. If a problem should either develop in a system or component originally inspected or the client believes that there was a misrepresentation of the property or its components by the inspector, the client agrees to contact the inspector, in writing, no later than 10 days following the discovery. The client guarantees the inspector the right to examine the subject matter in question before repairs are made (except in the event of an emergency, protect for personal safety, or to avoid damage to property).
In the event a dispute or claim should arise from the inspection or inspection report, it is agreed that this dispute or claim shall be resolved informally between the parties or by binding arbitration before the American Arbitration Association and use a gauge of performance under the Standards-of-Practice of the American Society of Home Inspectors (ASHI). Notice of the demand for arbitration shall be filed in writing to the inspection company and the American Arbitration Association within 180 days of the inspection.
THE INSPECTION PROCESS IS A TWO PART SYSTEM: THE VERBAL SURVEY AND THE INSPECTION REPORT. AS SUCH, THIS REPORT IS NOT TRANSFERABLE TO THIRD PARTIES AS IT WILL NOT CONVEY THE INFORMATION HEREIN. THIS REPORT IS PREPARED BY THE INSPECTOR AT THE CLIENTS REQUEST, ON THEIR BEHALF AND FOR THEIR USE AND BENEFIT ONLY: THIS REPORT, AND OTHER RELATED INFORMATION PROVIDED TO THER CLIENT PURSUANT TO THE INSPECTION AGREEMENT ARE NOT TO BE USED, IN WHOLE OR IN PART, OR RELEASED TO ANY OTHER PERSON WITHOUT INSPECTOR PRIOR WRITTEN PERMISSION.
The inspection fee is based on a single visit to the property. Additional fees may be charged for any subsequent visits required by, or asked by the client. If the inspector is called for litigation or to provide testimony as a result of the inspection, additional fees shall be charged at the inspector's then current hourly rate for any time spent, including, but not limited to, research, consultation, additional inspection time, preparation of reports, travel, time, waiting to testify, and court appearances. Any time spent from investigation due to a dispute or claim that renders through the arbitration process and is ruled in favor of the inspector will be billed to the client at the inspector's current hourly rate at the time of the dispute or claim.
The client has read this agreement, understands the scope of the inspection as well as it the inspections limitations. The client hereby authorizes the Inspections Unlimited to inspect the above listed property on page one of the inspection agreement and will pay the agreed upon fee of ________.
